Victorian Rail Safety Legislation

This Includes:

RSA Transitional Arrangements – Tourist and Heritage

  • Existing accredited Tourist and Heritage Organisations have a 3 year transitional period in which to comply with the requirements of the Victorian Rail Safety Legislation 2006.

  • However if Rail Safety requirements are met earlier the Operator is able to seek accreditation under the new regime prior to 1 August 2009.

RSA 2006 Tourist and Heritage - Existing Providers of Rolling Stock

       Currently there are 4 Tourist and Heritage AROs accredited as Providers of Rolling Stock

       On 1 August 2006 that accreditation will end 

       PTSV is currently scheduling exit audits in place of their annual safety audit.

       During this exit audit, on an individual case by case basis the providers will discuss and determine with PTSV what new status is appropriate:

    Rail Infrastructure Manager (RIM),

    Rolling Stock Operator (RSO),

    Rail Contactor or

    Apply for an exemption as an operator in a Private Siding.

 

RSO and RIM Exemptions

       Tourist and Heritage Operators may apply to the Director to waive:

    Both accreditation (application) and annual fees (Reg 53(2) and 54(2).

    Monthly reporting requirements (Reg 47)

    Demonstration of ongoing Risk Management requirements (RSA s.66)

 

       There is NO EXEMPTION from schedule 2 SMS requirements

 

RSA Tourist and Heritage – Exemption as an operator in a Private Siding

Requirements:

  • An SMS as Aligned to Schedule 3 of Rail Safety Regs

  •  Comply with the Safety Duties of an Operator

  • Outlined in more detail Private Siding Package to be sent to AROs from PTSV

Exemptions:

Schedule 2 SMS Requirements

Tourist and Heritage may apply to the Director to waive:

   Both accreditation (application) and annual fees (Reg 53(2) and 54(2).

   Monthly reporting requirements (Reg 47)

   Demonstration of ongoing Risk Management requirements (RSA s.66)

 

RSA Transitional Arrangements – Tourist and Heritage

After consultation with representatives of the sector DOI offers the following tailored assistance, during the 3 year transition phase:

  •   PTSV conduct SMS workshops by end of 2006

  •   PTD provide Risk Management support by end of 2nd Quarter 2007

  •   Regular DOI and ARO 6 monthly One on One progress meetings until 1 August 2009.

 Adequacy assessments will take place at appropriate and agreed intervals throughout the 3 year transitional period. 

 Assessment details will be provided during the workshops or information sessions.

    Safety Management Systems (SMS)

    Risk Management

    Competency of Rail Safety Workers
